When you decide to have work done to or near to the wall shared by your neighbour, you have a legal duty to serve a Party Wall Notice to all affected neighbours. An official agreement must be in place between the owner and adjoining owner for work to commence.
If an adjoining owner does not consent to the proposed works within 14 days of receiving notice, under the Party Wall etc. Act 1996, the parties will be deemed “in dispute”. At this point, both building owners and adjoining owners will need to appoint a surveyor for an agreement to be settled.
As defined in the Party Wall Act 1996, Party Wall Surveyors are any person who is not a party to the works. This rules out the possibility of an owner acting for themselves, enabling a fair agreement between both owners. The chosen person should have a great knowledge of construction, be well versed in party wall procedures and have the relevant qualifications. Building surveyors and structural engineers are usually the popular choices.
It is important to note that once a surveyor has been appointed under the Act, they have a duty to act in an impartial manner regardless of who appointed them. This can be hard to accept by some owners, as they would expect the surveyor to be on their side since they chose them. An owner will not be able to remove a Party Wall Surveyor if it turns out they are not taking their side, as under the Act this is not possible.
When surveying a party wall, a document is created, known as a Party Wall Award (also known as a Party Wall Agreement) that sets out the owners’ rights and responsibilities. It covers how the work should proceed, working hours, access for the surveyor(s) and what would happen in the case of any damage.
A Party Wall Agreement is necessary for building work to commence and is produced by two Party Wall Surveyors acting for their respective owners.
